Federal Code of Regulations (37.29) Prohibits holding more than one REAL ID card or more than one driver's license:

(a) An individual may hold only one REAL ID card. An individual cannot hold a REAL ID driver’s license and a REAL ID identification card simultaneously. Nothing shall preclude an individual from holding a REAL ID card and a non-REAL ID card unless prohibited by his or her State.

If the out-of-state identification card is REAL ID compliant then it is illegal at the Federal level to hold both that ID card and a REAL ID compliant driver's license.

The State of Texas has been producing REAL ID compliant driver's licenses since 2016.

The State of Texas is required, when issuing a REAL ID compliant driver's license, to check if the recipient holds a REAL ID card issued by another state. If so, then Texas is required to take steps to confirm that the ID card from the other state has been, or is being, terminated.

Section 521.009 of the Texas Transportation Code defines two types of certificates: election identification certificate and personal identification certificate.

Under Section 521.451, it is a general violation to possess more than one driver's license OR more than one valid certificate.

Section 521.183 states that a person only has to surrender identification certificates issued by Texas in order to get a driver's license.

This would seem to imply that it is not necessary to surrender, under Texas law, an ID card issued by another state in order to get a Texas driver's license.

Some states, such as California, issue both REAL ID compliant and non-compliant driver licenses and ID cards. The recipient decides which type of card is issued.

From the Department of Homeland Security FAQ regarding non-citizens:

REAL ID allows compliant states to issue driver's licenses and identification cards where the identity of the applicant cannot be assured or for whom lawful presence is not determined. In fact, some states currently issue such noncompliant cards to undocumented individuals. These cards must clearly state on their face (and in the machine readable zone) that it is not acceptable for official purposes and must use a unique design or color to differentiate them from compliant cards. DHS cautions against assuming that possession of a noncompliant card indicates the holder is an undocumented individual, given that several states issue noncompliant licenses for reasons unrelated to lawful presence.

License Surrender

If you are surrendering your Nevada driver's license for an ID card, you must do so in person at a DMV office.

No documentation is required unless you wish to upgrade to a Real ID at the same time.

General Information

The residency and proof of identity requirements for a Nevada identification card are the same as those for a driver license. You must be a resident of Nevada. The minimum age for an ID card is 10 years.

You cannot hold both an Identification Card and a Driver License, even if they are from different states. Nevada has a seasonal resident ID for those who reside in the state only part of the year.

Drivers who wish to surrender their license for an ID card must do in person at a DMV office. Review the Proof of Identity requirements to determine whether you should upgrade to a Real ID.

All documents must be valid originals or certified copies that were issued in the United States (except foreign passports). The DMV does not accept photocopies.

An ID card issued in compliance with the Real ID Act of 2005 is marked by a gold Nevada outline with a star cutout. It is a valid ID for boarding aircraft, entering federal facilities where ID is required or entering nuclear power plants.

How To Apply

To apply for an original Nevada Identification Card, you must:

• Provide acceptable proof of your identity and Nevada residential address.
• Apply in person at a DMV office. If you make an appointment, choose the "Drivers License - New" option.
• Complete an Application for Driving Privileges or ID Card (DMV 002):
  English  |  Spanish  |  Tagalog.
• Pay the required fee. (Under 18 - $9.25, 18-64 - $21.25, 65 or older - $11.25)
• Present any existing U.S. driver license, permit or ID card.
• Have your picture taken.

Any existing ID will be hole-punched and returned to you along with an interim paper document. Your new ID card will be mailed to you within 10 business days.

  NAC 481.005 - A "seasonal resident" means any person who is not a "resident" as defined in NRS 483.141 and who:

  • Temporarily resides in this State for a period of at least 31 consecutive days in each calendar year;
  • Maintains a temporary residence in this State;
  • Returns to the state or jurisdiction of his residence at least one time during each calendar year;
  • Is registered to vote or pays income tax in another state or jurisdiction; and
  • Does not engage in a trade, profession, occupation or gainful employment in this State.

  Seasonal resident identification cards are marked with a designation that the holder is a seasonal resident and is licensed in another state. You must meet the proof of identity requirements for a Nevada ID card. These cards are not issued to tourists from foreign countries.
